Illegal transportation of passengers. How and why we need to fight illegal bus transportation. Is permission required?

New minibuses and buses equipped with information boards, air conditioning and video recorders have appeared on the roads of the region. But some people really don't like it. Life figured out who and why wants to bring back chaos on the roads in the Moscow region.

In 2016, a reform began in Moscow that changed the passenger transportation market. Following the Moscow minibuses, those near Moscow have also changed: at the beginning of this year, new comfortable cars appeared on the routes of the Moscow region. They are radically different from the old ones - buses that smoked and fell apart while driving, with drivers who could hardly understand Russian, drove around the city and got into accidents.

Before the Ministry of Transport of the Moscow Region took on the passenger transportation market and held competitions to attract new companies, chaos reigned there. Dozens of companies that carried passengers daily from the region to Moscow and back, as well as on local routes, worked with a huge amount violations. Many did not have licenses, checks were issued to passengers only upon request, and even then not always, payment was accepted only in cash and nothing else.

The minibuses themselves from such carriers were in a terrible state - they were “rolled away” until they were completely overhauled, but they were repaired poorly and hastily. They also saved on drivers: such companies hired just anyone, gave preference to migrants, without caring about the driving skills of the drivers.

In the Moscow region, the situation with passenger transportation has not changed much since the 1990s, when this market was criminalized and companies were run by dishonest businessmen. Until recently, the region was divided by semi-legal carriers into sectors - each had its own firms. They almost never crossed paths, and if this happened, the companies agreed on how to divide the routes. It was extremely difficult for a new company to enter this market - there was pressure from the criminal lobby. Fares for travel were set by the carrier itself; on one route, the fare could constantly change.

The regional Ministry of Transport emphasizes that all work to bring this market into a civilized form was carried out strictly according to the law.

The competitions were held due to the need to bring route network in accordance with federal legislation,” the department’s press service said.

It was decided to fight illegal and semi-legal carriers by creating new routes and allowing new companies to enter the market. The results of open competitions for the transportation of passengers, announced by the Ministry of Transport of the Moscow Region, were summed up on February 1, 2017. One of the winners was the RAND-TRANS company, whose office is located in Domodedovo, near Moscow. The company has been engaged in this business for more than 20 years and during this time it has been able to become one of the most major carriers region.

It was possible to win the RAND-TRANS competition by meeting the strict conditions of the competition. In particular, only companies whose vehicles in their fleet were no more than two years old (three for medium and large class buses) were allowed to transport passengers. Machines must be equipped electronic scoreboard, air conditioning, video recorder in the cabin and adapted for the disabled.

Our minibuses are equipped with special equipment, so they can be used by disabled people; no one in the Moscow region has ever had this before. And the cars themselves are mostly Mercedes-Benz Sprinters no older than 2016,” said Alexander Malyshko, a representative of the RAND-TRANS company.

In addition, all cars are equipped with validators, which allows you to use the Strelka card to pay for travel. RAND-TRANS welcomes the use of this transport card- the company appreciates this innovation of the Moscow region authorities. Thanks to Strelka, paying for travel on public transport has become much more convenient: passengers of RAND-TRANS buses can forget, like a bad dream, the drivers of old minibuses who accepted money and counted out change while holding the steering wheel with their knees. In addition, passengers who pay for travel using a Strelka card are given discounts on RAND-TRANS buses.

The new minibuses also compare favorably with their drivers: RAND-TRANS hires exclusively Russian citizens who have not previously been responsible for serious accidents. The company currently has 1.8 thousand vehicles in its fleet; this is required by the ever-increasing number of routes covered by RAND-TRANS vehicles. Now there are about 150 of them, and with the update of the list of carriers, many old routes were adjusted - new ones appeared, and some of the old ones were combined. The route map is constantly changing depending on changes in passenger traffic, for example, 72 new routes were launched.

But illegal carriers are in no hurry to give up their profits and leave the roads near Moscow. Not only do they continue to transport passengers, putting them in danger every day, but they also try to smear new entrants into the market.

Illegal carriers, who had to leave the market and reduce routes, are naturally unhappy with this state of affairs. They order articles from dishonest media in which they throw mud at our company, accuse us of making the routes inconvenient and that people are suffering because of this. These people try not to mention the fact that they themselves carry passengers illegally and hire just anyone - all the negativity is directed in our direction,” says Malyshko.

There are still a lot of illegal carriers in the Moscow region, and identifying an illegal immigrant is quite easy.

It is very easy to distinguish a legal carrier from an illegal one: for example, all our cars are new, and the name of the carrier is on the windshield. If a person sees "RAND-TRANS", then he can be 100% sure that the transportation is carried out legally, that he will be given a ticket, which is insurance in case of an accident, says Alexander Malyshko.

In order to completely clear the Moscow region of illegal immigrants, significant efforts are required from the transport inspectorate and the traffic police. In fact, illegal immigrants in minibuses are the same bombers in private cars, only they work along a route. They themselves will not leave and will exploit profitable places to the last.

According to domestic legislation, transporting passengers without a license may result in fines. Their size depends on several factors, including the type of vehicle, the person (legal or individual), and the length of time driving without proper documentation.

Note! To obtain a license, an organization specializing in the transportation of people must have several vehicles, specialized drivers and maintenance personnel in its fleet. In addition, a full set of documents is submitted to the governing bodies as evidence of compliance with the requirements.

Legal driving conditions

Both a private organization and an individual are required to comply with the following requirements:

  1. The carrier must have a license allowing it to conduct activities related to passenger transportation. To register, you must contact the relevant Federal Transport Supervision Service. There is a branch of the organization in each region, so finding it will not be difficult.
  2. Transportation carried out under the pre-order scheme is carried out only subject to the preparation of a charter agreement. The parties are passengers and the organizer of transportation. As an exception, we can highlight passenger cars operating as taxis. In this case, the charter agreement is concluded exclusively orally.
  3. If the carrier plans to operate on a regular basis, when contacting the relevant authority, it is necessary to submit a route approval for verification. It is discussed with representatives of the Department of Transport, whose employees issue this document. After successful approval, the vehicle will receive a number, and the driver, in turn, will receive a route map. The latter determines the time of departure from “point A”, the time of arrival at the intermediate point (their number is indicated in the route map), as well as the time of arrival at the final “point B”.

The driver receives information about potential dangerous places along the travel route, the location of rest and food outlets, gas stations and hospitals.

Note! To transport passengers, it is necessary to comply with the established requirements imposed by the relevant legislation of the Russian Federation.

It is also worth noting that during licensing, individuals will not be able to obtain a permit. Citizens must obtain the status of an individual entrepreneur in order to provide their services without problems in the future.

If at least one of the specified conditions is not met, this leads to the recognition of the transportation as illegal. In this case, the person will be punished.

What are the consequences

If the vehicle is registered to a company that is conducting illegal activities, the latter is liable in various forms. For example, the most common measure is issuing fines. Due to their small amount, which is regulated by domestic regulations, illegal immigrants do not always stop working. The resulting fine for transportation can easily be covered by the price of the services provided.

The state government is doing everything possible to simplify the scheme for the legalization of regular and customized transportation, which are based on an increase in the amount of fines. In 2016, a bill was submitted for consideration that would increase the amount of fines. However, now no one knows when it will be implemented in practice.

If, after imposing a fine, an individual or legal entity does not answer for the actions committed, the state applies penalties in the form of confiscation of the car. This measure has been working in the Code of Administrative Offenses for a long time and is used very often.

But even if this did not help, and the private organization continues to engage in illegal activities, the company may be restricted not only from carrying out passenger transportation, but will also not be allowed to engage in other types of activities. The relevant authorities will conduct a comprehensive inspection, within the framework of which a temporary suspension of activities with mandatory freezing of bank accounts is possible.

Passengers

Due to the fact that citizens cannot see the difference between legal and illegal carriers, illegal transportation of passengers has less severe consequences for the latter. For example, the client may not receive the comprehensive service provided for in the charter agreement. Accordingly, people cannot move further and get to the place they need.

Delivery delays may also occur. This aspect is very relevant when using carriers who work on a regular basis, traveling along a specific route.

Passengers have the opportunity to seek compensation for material and moral damage caused. Violation of cargo transportation rules may result in harm to human health.

  • two copies of the above documents.

Your case will be reviewed within a month. If the decision is positive, a license is issued, the validity of which is five years. This permit must contain:

  • serial number.
